What is a trust?
A trust is a legal arrangement where one party (the founder) transfers assets to trustees, who are legally obligated to hold and manage those assets for the benefit of one or more beneficiaries. The relationship is governed by a trust deed, which sets out the terms, powers, and obligations of the trustees, and by the Trust Property Control Act in South Africa.

Trusts are used for a variety of purposes: to protect assets from creditors, to manage and distribute wealth across generations, to plan estates efficiently and reduce estate duty, to provide for minor children or dependants with special needs, and to ensure controlled distribution of assets rather than an outright bequest. Who controls a trust?
Trustees manage and control a trust in accordance with the trust deed and applicable South African law. Trustees have fiduciary duties to the beneficiaries and must act in the best interests of the trust at all times.
